Sharing important post from @mading.thok about Surveillance Pricing 💵
What is it?
It is the practice of using your personal data — location, browsing history, shopping habits, device type, even things like mouse movements or how long you hesitate before buying to set an individualized price for you, rather than one price for everyone.

How it works: Companies (often through third-party pricing consultants) feed your data into algorithms that infer things like your income level, urgency, or willingness to pay, then adjust the price you see accordingly. The FTC says the data used can include location, browsing history, shopping habits, and other personal signals, right down to what you leave in an online cart or how you move your mouse on a page. Basically it’s spying!

On August 19, 2026, the FTC issued a Proposed Enforcement Policy Statement for public comment, warning that using personal data to set individualized prices without adequate disclosure may violate the FTC Act.

However, FTC Chairman Andrew Ferguson has said the commission lacks legal authority to ban personalized pricing outright — but businesses that fail to disclose the practice could face prosecution. So the emerging federal approach is disclosure-based, not a ban.

A January 2025 FTC report had already confirmed the practice is widespread. Separately, California’s AG opened an investigative sweep in January 2026 into retail, grocery, and hotel businesses over the practice, and some states are moving toward outright bans, particularly in grocery delivery.

Some critics argue the new federal policy is weaker than it sounds, since a simple disclosure could satisfy the requirement without actually stopping the practice.
Practical tip from the FTC itself: browsing in private/incognito mode, using separate browsers for shopping versus buying, and clearing cookies can help avoid some forms of tracking-based price targeting.
