The City of St. Louis will not represent several jail correctional officers and supervisors accused of neglecting a detainee in a wrongful death lawsuit filed by the family of Samuel Hayes Jr., who died in custody last year.

According to the city charter, the counselor’s office is the chief legal adviser and attorney for the mayor, the Board of Aldermen and city departments. The counselor’s office is providing legal representation for the city, but workers have been left to retain their own attorneys in the Hayes lawsuit.

Samuel Hayes Jr.’ mother, Anita Washington, said the city’s decision to back away from covering the jail in the lawsuit, coupled with the fact that some individuals who may have been involved in her son's death are still employed there, feels like a “slap in the face.”

“Somebody needs to take accountability for something,” Washington said. “How dare you allow these people to still work for this city. Nobody won't take accountability for killing my son, and that’s so unfair to me. That’s why I'm so hurt, and I'm so pissed off.”

At least 22 people have died in custody at the St. Louis City Justice Center since 2020. The death of Dametria McDile, 32, was the most recent, earlier this year. A recent NAACP report said the jail quietly fired a nurse and correctional officer for ignoring McDile’s complaints that she couldn’t breathe.

Jail officials say they’ve been working to improve conditions by hiring more “quality” staff and removing bad actors, as well as expanding programs for detainees.

They were all held at the St. Louis City Justice Center, waiting for their day in court.

One, 32, died from complications of untreated diabetes, the city medical examiner’s office concluded. Another, 33, hanged herself in her cell and died days later from a lack of oxygen to her brain, according to her autopsy report. A third, 31, died of what the city described as an overdose, though his family called it negligence by jail employees.

Their cases were among at least 22 deaths at the jail since 2020 and 49 since it opened in 2002. A review of death records by @marshallproj and @stlpublicaradio found these deaths were not isolated incidents.

The analysis highlights long-standing issues, including inadequate medical and mental health care, understaffing and gaps in monitoring vulnerable detainees.

The City Justice Center has been St. Louis’ only jail since the Workhouse was demolished in 2025 after years of campaigning over hazardous conditions, including rats, roaches, mold and extreme heat.

But conditions at the current jail have also raised alarm, including faulty locks, weeks without sunlight or fresh air, and shortages of basic hygiene supplies such as soap and sanitary pads.

More than 8,500 children arrested by ICE during Trump’s second term. More than 8,750 held in ICE custody. These are counts of children—not families—and they come from The Marshall Project’s October 2026 reporting.

Meanwhile, children are facing immigration judges without lawyers. In one Arizona case described in court filings and reported by The Marshall Project, a 1-year-old appeared without legal representation, and the judge ordered an asylum application filed by the next hearing.

A child too young to read should not have to navigate a legal system that can decide where they are allowed to grow up. These are children. Their safety and dignity should not be partisan.
