#NYShitty🗽💩; Stop-and-frisk in #NewYorkCity is a complex and controversial issue with a long legal history. While the practice itself is not entirely illegal, its implementation has been subject to significant legal challenges and restrictions.

The #stopandfrisk practice in #NYC is based on the U.S. Supreme Court decision in Terry v. Ohio, which allows police officers to briefly detain and search individuals if they have reasonable suspicion of criminal activity. However, the way the #NYPD implemented this practice was found to be unconstitutional in 2013.

In August 2013, U.S. District Court Judge Shira A. Scheindlin ruled that the NYPD’s stop-and-frisk tactics violated the Fourth Amendment’s prohibition of unreasonable searches and seizures and the Fourteenth Amendment’s guarantee of equal protection. This landmark decision in Floyd v. City of New York found that the policy was being used in a racially discriminatory manner, disproportionately targeting Black and Latino citizens.

Despite the 2013 ruling, stop-and-frisk practices have not been completely eliminated in NYC:

1. Reduced but still present: The number of stops decreased significantly after the ruling, from a peak of 685,724 in 2011 to 12,404 in 2016. However, recent data shows an increase under Mayor #EricAdams’ administration.

2. Ongoing concerns: Reports indicate that the NYPD continues to conduct stops that may not comply with constitutional requirements. A 2024 monitor’s report found that certain units, particularly the Neighborhood Safety Teams, are still making a high number of potentially unlawful stops.

3. Lack of discipline: A recent 500-page report revealed that the NYPD has failed to adequately discipline officers who violate citizens’ rights during stop-and-frisk encounters.

4. Racial disparities persist: In 2022, 59% of those stopped were identified as Black or African American, despite making up only 24% of New York City’s population.
