California Employers: Arbitration Agreements Get a Boost A recent decision from the California Court of Appeal reinforces the enforceability of arbitration agreements governed by the Federal Arbitration Act (FAA). Here’s the key takeaway: when an employment agreement expressly states that it is governed by the FAA, courts may enforce that provision without requiring separate proof that the employment relationship involves interstate commerce. In this case, an employee brought several wage-and-hour claims under California law. The employer moved to compel arbitration based on an agreement stating that arbitrable claims would be governed by the FAA. The employee argued the FAA shouldn’t apply because there wasn’t sufficient evidence of interstate commerce. The appellate court disagreed. Relying on precedent from the Supreme Court of the United States, the court emphasized that arbitration is a matter of consent, and parties are generally free to structure their agreements, including choosing FAA governance. Because the parties clearly agreed the FAA would apply, the court held that the provision was binding and enforceable, without needing additional proof of interstate commerce. Why this matters for employers: • Courts may enforce clear FAA choice-of-law provisions in arbitration agreements • Employers may not need to independently prove interstate commerce when the agreement expressly adopts the FAA • Careful drafting of arbitration agreements remains critical An appeal to the Supreme Court of California is possible, but for now this case signals that courts may be willing to enforce clearly written FAA-governed arbitration provisions. . . . #TheParkmanLawFirm #freeconsultation #consultation #construction #constructionlaw #constructionlitigation #business #businesslaw #wageandhour #humanresources #hr #law #legal #litigation #transactional #lawyer #attorney #help #aid #lawfirm #sandiego #scrippsranch #california #ca #FAA #Arbitration #EmploymentLaw

First game of the season ✅ Score more goals the the NY Rangers ✅ Win as many games as the SJ Sharks ✅ Dropped the season opener 6-5. These growing pains will work themselves out. Shout out to @serpenoticshockey for the best wax in the game. Performs as good as it smells.
