STATEMENT: The Consent Awareness Network re: Harvey Weinstein Verdict Overturn

Hey, Attorney Mark Werksman: Agreement under duress IS NOT CONSENT - it’s ACQUIESCENCE.

CONSENT is #FGKIA: freely given, knowledgeable informed agreement. That means if compliance is induced through malicious means such as force, fear, fraud or exploitation of incapacity: THAT AGREEMENT IS NOT CONSENT - no matter WHAT the victim said or did.

The Consent Awareness Network is fighting to correctly define CONSENT in penal codes everywhere so predatory defense attorneys will no longer have the legal permission they currently do of ripping apart witnesses on the stand.

Stood in solidarity today with survivor sisters Gloria Allred, Caitlin Dulaney and Pamela Guest at the Harvey Weinstein criminal trial in support of his victims testifying on the witness stand of the Downtown LA Superior Courthouse. During lunch break, we were interviewed by ABC Nightline.

The last three photos in this group are from February 24, 2020 at the Echo Trauma & Resilience Conference. In the third to the last photo, I’m standing with multiple Weinstein survivors, including Caitlin Dulany and Echo founder/director Louise Godbold. Several of us presented various healing-related talks and workshops at the conference. Serendipitously, that same morning, a jury of his peers declared Harvey Weinstein guilty in his New York criminal trial.

Praying for the same outcome here in California.

Thanks to @lapinchekarina for organizing a wonderful #womenswave and including #FGKIA because #consent is at the intersection of #Abortionrights and #sexualassult. Consent is a #humanright - we need to make it a #civil-right backed by law!

Bittersweet #memory / #anniversary 🙌🏽 Thank you @Variety and @EWagmiester for sharing this photo & featuring #SilenceBreakers @CaitlinDulany & @SarahAnnMasse in this amazing article.

Repost from @Variety:

Five years ago today, the Harvey Weinstein story broke, igniting a global reckoning. Though much has changed in the world since then, the entertainment industry still has a long way to go to untangle its complex web of decades of bad behavior.

"I really feel that while we've gotten to the point as a society where we realize that living without sexual assault is a basic human right and we're aware of how pervasive it is, but the justice system really still needs to catch up," says survivor Caitlin Dulany, who was one of more than 100 women who accused Harvey Weinstein. (She and some of her fellow Silence Breakers are pictured here.)

Next week will see the start of new trials for Weinstein, Kevin Spacey, Danny Masterson and Paul Haggis. The fight for change that began nearly five years ago with those initial stories will be litigated once again in courtrooms across America in the coming weeks.

"NOTHING CHANGES UNTIL WE CHANGE OUR LAWS" - Ruth Bader Ginsburg

WE NEED YOU!

The Consent Awareness Network (CAN) is outraged that this predator has been granted the right to appeal by a NY York Court. We stand with the survivors.

At the heart of this matter lies CONSENT, which IS NOT DEFINED IN NEW YORK PENAL CODE. Incredibly, when the Weinstein jury asked Judge James Burke for the legal definition of CONSENT in NY's laws, what was his response?

"USE YOUR COMMON SENSE"

We can't leave this appeals process to chance!

We have a solution to fortify the current guilty verdict during these new proceedings: DEFINE CONSENT in NY law!

New York Bill A6540A defines CONSENT as #FGKIA: freely given, knowledgeable informed agreement - BUT we need to push it out onto the floor for a vote.

YOU CAN HELP pass this into law! Sign, share and comment on our petition to pass NY Bill A6540A (link in bio)

TW: Sexual Trauma

Actor @kkbutter was only 23 years old when Harvey Weinstein lured her into his apartment, and then cornered and sexually traumatized her. For years she felt silenced and powerless, fearing backlash if she reported the then influential producer.

Years later in 2017, Katherine bravely spoke out. She was one of the first women to publicly speak out against Weinstein in a New York Times article, sending a ripple effect that would ignite the #MeToo movement.

In this episode of Beyond the Prescription, the actor details her journey of overcoming the shame of being sexually traumatized; grappling with the physical manifestations of emotional pain; and finding the courage to advocate for other survivors.

This episode is a powerful one, you won't want to miss it! Give it a listen on Apple Podcasts, Spotify, or whenever you get your podcasts. And please don't forget to subscribe and share! 🙏
