Housing societies and individuals who illegally remove or dump community animals away from their natural territories are committing a recognized criminal offense under Indian law.

In an essential legal awareness reel, Senior Police Inspector Sudhir S. Kudalkar breaks down the severe legal ramifications of animal relocation and explains how citizens must take immediate action when stray animals are illegally removed.

🔍 Key Legal Provisions & Police Guidelines:

🚫 Relocation is Illegal: Under the Animal Birth Control (ABC) Rules, 2023 (Rules 8, 11, 19 & 20) and the Prevention of Cruelty to Animals Act, 1960 (Section 11), picking up community dogs or cats and dumping them elsewhere is strictly prohibited.

💔 Fatal Consequences: Relocated animals lose access to regular food, shelter, and medical care. They are often attacked by territorial packs in new areas, leading to severe injury or death.

🚨 Mandatory Police Action: If an individual or society committee illegally relocates an animal, citizens must lodge a formal complaint at their local police station immediately.

🔙 Compulsory Return: Police will summon the culprits to the station and legally mandate that the relocated cat, dog, puppy, or kitten be brought back to its exact original community spot.

⚖️ Section 325 BNS Invoked: If an animal suffers injury, harm, or death due to illegal relocation, charges under Section 325 of the Bharatiya Nyaya Sanhita (BNS) (Mischief by killing or maiming animals) can be added, carrying severe penal consequences.

🚨 What Should You Do If a Society Relocates an Animal?

Document Evidence: Collect CCTV footage, photos, or witness statements of the relocation vehicle/persons involved.

File a Police Complaint: Approach your local police station immediately and reference the ABC Rules 2023 and Section 325 BNS.

Ensure Safe Return: Demands that police enforce the animal’s immediate return to its original territory.

Do not stay silent when community animals are illegally removed. Stand up, file a complaint, and enforce the law! ⚖️🐕
