USCIS has ended the 540-day automatic EAD extension for affected renewals. Is your category affected?

If you are renewing your Employment Authorization Document (EAD), your category and filing date matter.

The change affects categories including:
• C08: Pending asylum or withholding
• C09: Pending adjustment of status
• C10: Certain cancellation of removal and NACARA applicants

For eligible renewals received before October 30, 2025, an automatic extension of up to 540 days may still apply, subject to the applicable requirements. Affected renewals received on or after that date do not qualify for an automatic extension under this rule.

Check the Received Date on your Form I-765 receipt notice, not just the date you mailed it.

If your EAD expires before your renewal is approved, you may face a gap in work authorization unless another valid basis allows you to work. Some categories and separate extensions follow different rules.

Review your category, expiration date, and renewal status with a qualified immigration attorney before your card expires.

The NYPD's Strategic Response Group (SRG) has consistently threatened, attacked, and arrested protesters. SRG officers have demonstrated a clear pattern of targeting people of color and using excessive force - and the city has spent millions on legal settlements stemming from their misconduct.⁠

Fortunately, there's a bill to help fix this: the CURB Act. Unfortunately, it's languishing at City Council, because Public Safety Chair Oswald Feliz won't schedule the bill for a hearing, and the Council can't vote on a bill without one. Comment "CURB" to take action now.
