The IIT Mandi poster depicting Shudras in terms of their ascribed role for “serving higher classes” represents the stubborn persistence of the scourge of the caste system rooted in “…an ascending scale of reverence and a descending scale of contempt.” It is, therefore, violative of the Constitution and the constitutionally enshrined ideals of dignity and fraternity.
According to Indian Express, a three-member inquiry committee, constituted by IIT Mandi to examine the controversial casteist poster displayed during a Janmashtami programme on the campus, found “no evidence of any intention to target, insult or hurt any individual or community.”

Yesterday, the Supreme Court bench led by CJI Surya Kant found “considerable force” in the reasoning that judicial officers, from their very first day in office, are required to deal with matters of “life, liberty, property and personal rights,” making familiarity with court procedure and the working relationship between the Bench and the Bar necessary.

An RTI based investigation by The Leaflet now shows that Aligarh Muslim University misrepresented data and NIRF simply accepted it on face value. Data reveals that approximately only 10 students were placed leaving 172 placements that Aligarh would need to account for from a batch of 123 graduates!

“AMU may be the subject of this piece, but it is certainly not alone in gaming a system that makes gaming easy. When 16 percent of a ranking score depends on placement numbers that no external body verifies, the incentive is universal. The question isn’t why an institution would overstate its figures — the question is why more wouldn’t,” writes Syded Mohammed Nasif.

A nine-judge Bench, in a 5:4 majority, has refined the triple test laid down for interpreting “industry” in the Bangalore Water Supply case. The refined test will apply prospectively, and will not affect pending disputes or proceedings under the Industrial Disputes Act, 1947.

The dissenting opinions on merits were delivered by Justices B.V. Nagarathna, Dipankar Datta, Ujjal Bhuyan, and Joymalya Bagchi.

“The importance of how ‘industry’ is interpreted is rooted in the legal realities of who gets to be a workman, and the protections that come with it. If the definition is narrowed, millions of workers would lose the ability to approach Industrial Tribunals to adjudicate issues concerning them, while also facing a direct impact on the rules governing strikes, lockouts, retrenchment, layoffs, and the closure of undertakings.”

The long-standing cloud over the legality of ex-post-facto clearances has been cleared by a three-judge bench of the Supreme Court in Vanashakti v. Union of India, also known as the Vanashakti III case. The Court struck down the 2021 Office Memorandum, which permitted violators to regularise ex-post-facto breaches of environmental law for an indefinite period, while upholding the 2017 notification, which opened only a six-month window for violators to exercise this relief.

“Vanashakti I had welded the door shut restraining the government from ever issuing such an instrument in any form with Vanashakti II reopening the controversy by reviving both the 2017 Notification and the 2021 Office Memorandum. Vanashakti III now replaces the weld with a lock and issues three keys,” writes Mahesh Menon for The Leaflet.

While the BCI withdrew its directions it raised brows on whether the members of the council had sufficient dialogue and had agreed to the issuing of such a sweeping direction.

Three lawyers’ collectives with over 150 signatories have urged Mishra to step down, failing which, they will approach the BCI members.

This 80th year is a decisive moment where the youth of the country once again have taken the leading role in deciding this country’s future,” writes Neha Bora for The Leaflet’s Independence Day Special Issue.

“We feel that receiving our degrees from a dignitary whose recent public conduct, as reported, appears dismissive of serious allegations of police brutality against protesting citizens sits uncomfortably with what we have been taught to value during our time at NALSAR,” wrote the graduating batch in their mail addressed to the University’s Vice-Chancellor, Registrar, and faculty.

In the last three weeks, three different varsity convocations at which the CJI was slated to appear as the chief guest were either contested by students, declined by him, or abruptly postponed.

The Judges Inquiry Committee’s Report, tabled in the Lok Sabha today, holds former Delhi High Court judge Justice Yashwant Varma guilty on all counts in the cash-at-residence case.

The Committee found that unaccounted currency was present in a storeroom under his control, that evidence was tampered with before it could be sealed, and that his explanations to the Committee were evasive and inconsistent over time.

The findings closely mirror those of the Supreme Court’s earlier In-House Committee, which had already recommended his removal before he chose to resign in April this year, withdrawing from the JIC proceedings midway.

This week’s roundup on Constitution First takes a look at the actual impact and precedent set by the Goa bench of the Bombay High Court’s decision in the case of Tarun Tejpal as it convicted him and sentenced him to an imprisonment of ten years in a case which dates back to 2013 in which the trial court had earlier acquitted the former editor of the Tehelka Magazine.
