Red Bull has won a major legal reprieve in India after the Delhi High Court overturned an FSSAI order that prevented the company from using the “energy drink” label. The court found that FSSAI had issued the order without giving Red Bull an adequate opportunity to present its case, making the regulatory process procedurally unfair. The dispute concerns FSSAI’s attempt to restrict the “energy drink” label over concerns involving caffeine, sugar and taurine levels. FSSAI is expected to challenge the ruling, while the court’s decision currently allows Red Bull to continue using the disputed label.
