Senate impeachment court bars revival of 3 dropped charges vs VP Sara

The Senate impeachment court on Tuesday accepted the prosecution’s move to withdraw three of the four impeachment articles against Vice President Sara Duterte, leaving only the unexplained wealth charge for adjudication.

On Day 39 of the trial, Presiding Officer Francis “Chiz” Escudero ruled that Articles I, III and IV would no longer be submitted to the senator-judges for a vote or verdict, as no charges under these articles remained for adjudication.

“Article III may not be revived in this trial until its conclusion,” Escudero said, adding that the three articles could no longer result in a verdict of conviction or acquittal. by @verafilesph

Prosecution drops 3 charges; defense cries foul

Tensions flared on Day 39 of Vice President Sara Duterte’s impeachment trial on Tuesday after prosecutors announced they would drop three impeachment articles and pursue only the charge of unexplained wealth.

“All in po tayo dito,” House lead prosecutor Gerville Luistro said, asserting that the evidence was substantial and compelling enough to warrant Duterte’s removal for culpable violation of the Constitution and betrayal of public trust.

Defense lead counsel Sheila Sison pushed back, arguing that the prosecution could not abandon the accusations without giving the defense a chance to challenge them. “The prosecution cannot be allowed to have the benefit of its accusation without bearing the burden of having those accusations tested,” she said. by @verafilesph

Defense: Dropping charges after damage done ‘unfair’ to VP Sara

Defense lead counsel Sheila Sison said the prosecution’s decision to drop three impeachment articles against Vice President Sara Duterte should not deprive the defense of the opportunity to present its side, warning that doing so would be unfair to her client.

“We believe that this is not fairness and it is not in keeping with the guarantees of due process,” Sison said.

She said the right to be heard goes beyond presenting evidence and includes a meaningful opportunity to respond to material accusations.

Sison stressed that the prosecution’s decision should not curtail the defense’s presentation of evidence, arguing that the prosecution could not make allegations against Duterte without allowing them to be tested. by @verafilesph

Prosecution drops 3 impeachment charges, focuses on Sara’s wealth

House lead prosecutor Gerville Luistro on Tuesday manifested before the impeachment court the prosecution 's decision to drop three of the four Articles of Impeachment against Vice President Sara Duterte and focus solely on Article II, which accuses her of unexplained wealth.

"It will no longer pursue three of them... It will stand on one: and that is Article II on unexplained wealth," Luistro said on Day 39 of the trial. Article I covers alleged misuse of P612.5 million confidential funds, Article III on bribery, and Article IV on grave threats.

“All in po tayo dito. We believe that the evidence is substantial and compelling and warrants the respondent’s removal from office for culpable violation of the Constitution and betrayal of public trust,” Luistro said, referring to Article II.

She said concentrating on the unexplained wealth charge was the most judicious course, consistent with the evidence and the prosecution panel’s duty to the nation. by @verafilesph
