ICYMI: We filed a petition directly with the Wisconsin Supreme Court asking it to require the government to obtain a judicial warrant in order to search data collected by ALPRs like Flock and Axon cameras.

We need protections while communities work to dismantle the vast ALPR camera network tirelessly photographing, identifying, and storing the movements of vehicles and license plates across Wisconsin.

If police want to surveil an individual, they should be required to obtain a warrant signed by a judge.

Searching Flock data without a warrant is unconstitutional, so we're taking legal action on behalf of @wichurches and an individual pastor.

ALPR technology like Flock or Axon scans and stores vehicle data from countless drivers every day, enabling the government to track where people drive and when — without their knowledge or consent and without a warrant. These devices collect everyone’s data, not just data on vehicles associated with a crime.

The U.S. Supreme Court has recently established that such pervasive tracking over time invades a reasonable expectation of privacy, converting otherwise public observations into an unconstitutional search.

Wisconsin’s State Constitution provides protection from unreasonable searches and therefore guards against this exact form of indiscriminate electronic dragnet. Accordingly, law enforcement’s retrospective querying of these kinds of ALPR databases without any constitutional safeguards constitutes illegal searches.
