It’s not the popular opinion but it’s the truth. If the statement released by the DA is truly what Jane Doe said, there was no crime reported and no lack of consent to investigate existed.
•
New York law defines a lack of consent in 3 ways:

1. Forcible compulsion, meaning physical force or a threat that puts the person in fear of injury, death, or kidnapping.

2. Incapacity to consent, which covers people the law treats as unable to consent, including minors under 17, people who are physically helpless (for example asleep or unconscious), mentally disabled or incapacitated, or in certain custodial situations.

3. Clearly expressed non-consent (mainly for third-degree rape and criminal sexual act): the person clearly expressed through words or actions that they didn’t consent, and a reasonable person in the defendant’s position would have understood that.

There’s also a fourth provision for lesser offenses like sexual abuse and forcible touching. Under it, lack of consent is shown whenever the person didn’t expressly or impliedly agree to the act.

If her statement truly was how it’s being recorded, none of those scenarios were alleged. by @akincontempt
