What to photograph after a car accident, and why it matters later.

Your phone is one of the most useful things you have after a crash, as long as you know what to point it at. Here’s what to capture:

The wide shot. Get both vehicles exactly where they stopped, before anything is moved. Where the cars ended up tells a story that’s hard for an insurance company to argue with later.
Close-ups. Photograph license plates, damage to both cars, and anything that shows how it happened, like skid marks or a broken tail light.
The surroundings. Capture traffic signs and signals, road conditions, weather, and lighting. Was it raining? Was it dark? Was a stop sign hidden behind a tree? That context matters more than most people expect.
Your injuries. If you’re hurt but able to move, photograph visible injuries, even minor ones. Bruises change and cuts heal, so a record from right after the crash is worth having.

If you’re seriously injured, skip the photos. Getting medical care always comes first.

Why it matters: memories fade, cars get repaired, and insurers often push to settle quickly. Photos don’t change their story. Two minutes at the scene can make a real difference to your claim.

Medical bills prove themselves. Missed work usually doesn’t.

Lost income is part of a California injury claim, but it’s often the part people document the least. A hospital bill shows up in writing. The days you couldn’t work often only exist in your memory, and that’s hard to rely on months later.

Two things tend to make the difference:

Your doctor’s notes. Tell your doctor what your job actually involves, so any work restrictions go into your medical chart. That connects your time off to the injury.
Proof of what your time is worth. Pay stubs, tax returns, invoices, even jobs you had to turn down.

Start a simple running list of every day you miss. And if you’re already months in and didn’t keep track, that’s okay. Bring what you have to a lawyer. Payroll and tax records can fill in a lot of what memory can’t, and they’re written proof of what you actually lost.

Who’s responsible when a driverless car hits someone?

San Diego’s City Council recently voted 8–0 to ask Sacramento for more local control over autonomous vehicles. It raises a question I hear often: what happens if a Waymo causes a crash?

With no driver, the claim is usually against the company operating the car, and sometimes the companies that built it. The good news is that these cars record video and sensor data constantly, and an attorney can ask the company to preserve it.

Your steps are the same as in any crash: call the police, photograph the car and plate, get witness names, and see a doctor. California’s general two-year deadline to file an injury claim still applies.

What am I still competitive about? Fair warning: this one’s a little corny.

When I played basketball, keeping score was easy. You looked up at the scoreboard and the numbers told you how you did.

Practicing law doesn’t come with a scoreboard. So these days, the person I’m competing with is me.

The question I ask myself on every case is simple: did I do the best job I possibly could for this client, and did I get them the best result the circumstances allowed?

Client satisfaction matters to me enormously, and I work for it every time. But the real measure is whether I can go to bed at night knowing I gave each person everything I had. That’s a better standard than wins and losses, and it’s one I hold myself to on every single case.

Corny? Probably. True? Absolutely.

My hands are busy, but my head is usually somewhere else. Replaying a call with a client. Thinking about what the insurance company is likely to argue next. Wondering if there's something we haven't tried yet.

People sometimes ask whether it's hard to switch off in this job. Some days, yes. When someone trusts you with one of the hardest stretches of their life, it tends to follow you home.

I've made peace with that. It's a big part of why I handle every case myself. You're not a file that gets passed down the hall. You're someone I'm thinking about, sometimes at 9pm while I'm loading the dishwasher.

(I'm still working on the switching off part.)

Can an insurance company really use your Instagram against you?

Yes. Anything you post publicly can be treated as evidence in your injury claim.

If you're saying a knee injury keeps you from working, and there's a video of you on a hiking trail last weekend, the insurance company is going to notice. They'll use it to argue that you're not as hurt as you say.

That doesn't mean you have to stop living your life. Go to your kid's birthday party. Take the photo. Smile in it. Being in pain doesn't mean you're unhappy every minute of the day, and a smile in a picture doesn't prove you're fine.

Just post with that in mind. If you're in the middle of a claim, it's worth thinking twice before you share, and checking your privacy settings while you're at it.
