Want to start or buy a business in the U.S.? The E-2 Treaty Investor visa may be an option. Here are the basics. 👇

• You must be a national of a treaty country, and the business must be at least 50% owned by treaty nationals. Not every country is on the list (India, China and Brazil aren’t).
• There’s no fixed dollar minimum. The investment must be “substantial” compared to the cost of the business, at risk, and irrevocably committed.
• The business can’t be marginal. It needs to earn more than a minimal living for you and your family, or make a significant economic contribution.
• Admission is up to 2 years at a time, with extensions available, but E-2 doesn’t lead to a green card on its own.
• Your spouse is work-authorized, and unmarried children under 21 can go to school in the U.S.

LLC, S-corp or C-corp? The entity you pick shapes your taxes, who can own the business and how you can raise money. 👇
• LLCs and S-corps generally pass profits through to the owners’ returns. C-corps pay 21% federal tax, and dividends are taxed again.
• S-corp owners who work in the business must be paid a reasonable salary through payroll.
• An S-corp can have no more than 100 shareholders and one class of stock, and no nonresident alien owners. That matters for many immigrant founders.
• Raising venture capital? Investors generally expect a Delaware C-corp.
• In New York: LLCs have a 120-day publication requirement, the State needs its own S election (Form CT-6), and NYC doesn’t recognize S status.

Doctors: the Physician National Interest Waiver is one of the few green card paths you can pursue without PERM. But these 3 myths trip people up. 🩺

❌ “I need an employer to sponsor me through PERM.”
✅ You can file the petition yourself, with no PERM labor certification. You still need a qualifying full-time clinical job in an underserved area or VA facility.

❌ “My J-1 years count toward the 5.”
✅ Time in J-1 status doesn’t count. Qualifying service usually starts after the waiver.

❌ “I-140 approved = green card.”
✅ USCIS won’t approve the green card until all 5 years of qualifying service are complete and documented.

The $100K H-1B fee isn’t being collected right now. But it isn’t dead either. 👇

Where things stand (as of Oct. 6, 2026):
• Sept. 2025: a proclamation required a $100,000 payment with certain new H-1B petitions
• June 8: a Massachusetts federal court vacated the fee policies
• July 24: the First Circuit refused to reinstate it, and USCIS stopped collecting
• Sept. 18: the proclamation was extended through Sept. 2027
• Sept. 30: a California federal court blocked enforcement under both proclamations

Appeals are ongoing, and DHS has a separate proposed $103,265 fee for cap-subject petitions. That one is not final.
