Submitted a formal 7-page written public comment to the West Hollywood City Council for tonight’s meeting (October 5, 2026). 📝👁️

This submission brings my public record filings on West Hollywood’s municipal surveillance apparatus - including CPRA requests, my initial CA DOJ complaint and six supplemental filings, Public Safety Commission submissions, LA County Board of Supervisors oversight letters, and a pending LA County Civil Grand Jury audit investigation request - to over 100 pages written since July. 📑

The intense writing begins now. ✍🏼 📰

In the last five days alone, federal court rulings, proposed federal legislation, new state AI mandates, and county actions have drastically altered the legal and fiscal reality surrounding municipal surveillance: 🗂️

• Federal Fourth Amendment Ruling: United States v. Kyle (Oct. 1) suppressed historical Flock location searches as "indiscriminate mass surveillance," establishing direct § 1983 liability exposure.

• Federal Funding at Risk: The Ban Flock Act (introduced Oct. 2) conditions federal transit, housing, and justice grants on binding local ALPR bans.

• State AI Mandates: California’s Sept. 30 AI package limits automated tracking and requires human-review safeguards, creating First Amendment and workplace compliance risks around municipal facilities.

• State & County Enforcement: Ongoing litigation under California’s constitutional right to privacy (ACLU v. City of San Diego) and strict county bans on covert AI tracking (LA County Board Policy 6.106).

West Hollywood’s $1.47M surveillance contracts are operating on shifting ground. The record is clear, and the questions are now formally before the Council. ⚖️

Flock admitted it to Congress. City of West Hollywood hid it.

In a formal response to the U.S. Senate (FLOCK-SEN-JH-00000001), Flock Safety claimed its cameras "do not capture audio or biometric templates".

Read Footnote 2: That assurance is strictly scoped only to their standard license-plate readers (LPRs).

It does NOT cover what West Hollywood actually bought under Contract No. 011578:

📹 54 Condor PTZ Cameras (live-streaming 25x zoom).

📢 Mobile Security Trailers with built-in "Audio Talk Down" speakers.

While Flock assures Capitol Hill their basic LPRs don't record audio, West Hollywood deployed an audio-capable, pan-tilt-zoom apparatus across our streets—marketed quietly as the "Real-Time Watch Center."
