🌱 888 restrictions. 567 contested projects. 38 false claims examined.

New research from the Sabin Center’s Renewable Energy Legal Defense Initiative (RELDI) documents the growing challenges facing renewable energy development in the United States.

1️⃣The 6th edition of Opposition to Renewable Energy Facilities in the United States identifies:
📍 888 state and local restrictions across 48 states
⚡ 567 renewable energy projects that have faced significant local opposition
🚫 Approximately 40% of contested projects have been canceled
The report also finds that wind energy is the most frequently targeted technology, with 416 restrictions directed solely at wind development.

2️⃣Since local opposition is often grounded in mis- and dis-information, the Sabin Center has also released another report, Rebutting 38 False Claims About Solar, Wind, Electric Vehicles, and Battery Storage, updating the Sabin Center’s 2024 analysis with five new claims to the 33 addressed previously.

🌊 How should international law govern marine carbon dioxide removal (mCDR)?

The parties to the London Convention and London Protocol are meeting this week to discuss key questions surrounding the governance of mCDR—including how proposed research projects should be assessed under the treaties.

In a new Climate Law Blog post, Sabin Center Senior Fellow Korey Silverman-Roati and Deputy Director Romany Webb examine the legal questions around assessment frameworks, scientific research, and the role of private financing in mCDR research. ⚖️🌎

🪸📈 As interest in marine carbon dioxide removal grows, developing effective governance frameworks will be critical to supporting responsible research while protecting the marine environment.

⚖️ Engaging in climate law and policy
📜  The Sabin Center recently filed a brief with the New Jersey Supreme Court in support of the New Jersey Department of Environmental Protection’s cumulative impact and environmental justice regulations. 
💬 We also submitted comments to the U.S. Department of Agriculture urging the agency to maintain protections against road construction and large-scale commercial timber harvesting in national forests.

⚖️ Suncor v. Boulder and the future of climate litigation against fossil fuel companies ⚖️

On Monday, the Supreme Court’s 2026-2027 term will open with a major climate case: Suncor Energy Inc. v. County Commissioners of Boulder County. The case will explore if the Constitution and Clean Air Act permits state and local governments to hold fossil fuel companies liable for climate change-related injuries.

This year, Sabin hosted and participated in 15 #ClimateWeekNYC events throughout NYC!

🗽On Monday, we hosted “Mind the Gap: How States Can Advance Carbon Dioxide Removal,” which featured Sabin’s Deputy Director Romany Webb, Negative Emissions Fellow Ashwin Murthy, and other experts to discuss how U.S. states can meet temperature limits set in the Paris Agreement amid federal funding cuts on carbon dioxide removal.

🇧🇷On Wednesday, we co-hosted “The Future of Climate Litigation Worldwide and Best Practices for Brazil” with the University of São Paulo (USP), Pontifical Catholic University of Rio Grande do Sul (PUC-RS), Fórum Ambiental do Poder Judiciário (FONAMB), Instituto O Direito Por Um Planeta Mais Verde (IDPV), and IDP to discuss legal practices, strategies, and trends for climate litigation in Brazil. Sabin founder Michael Gerrard delivered the opening lecture and closing remarks.

☁️We and the Vance Center for International Justice hosted “The Evolving Landscape of Climate Litigation: U.S. and Global Perspectives” to discuss legal disputes that address climate obligations and human rights at the national and global level. Katrina Kuh, professor of environmental law at the Elisabeth Haub School of Law at Pace University, discussed the upcoming Suncor Energy Inc. v. County Commissioners of Boulder County case. ⚡On Friday, Michael Burger , Romany Webb, and RELDI Fellow Andrew Kieffer hosted “Powering Through: Tools and Resources to Combat Myths and Local Opposition to Renewable Energy Siting” to discuss the challenges facing utility-scale renewable energy siting across the United States, along with the launch of two new Sabin Center reports on renewable energy siting and on false and misleading claims about renewable energy impacts.
