I’ve been quiet about this for the last month but I can finally share the news. I’m proud to represent fellow independent artists everywhere as the lead plaintiff in a federal class action lawsuit Kogon versus Google. It’s taken me years to develop my voice and my craft spending thousands of hours practicing to get the tones and the things I wanna say and sing just right. This is about what Google and many companies take from us without ever paying for it. They’ve used our songs to train AI that now directly competes with us. I wasn’t expecting for the case to be named after me but I’m honored to stand up for the underrepresented. I am standing up for the ones who don’t have label execs making deals on their behalf (myself included). It’s really my David and Goliath moment. We have livelihoods and intellectual property to protect. The human soul and spirit cannot be turned into numbers and code. My original music and voice shouldn’t be used to train AI for corporate profit without even getting an acknowledgment or being asked. I’m fighting for my music, for my peers, and for the soul of what we do. #KogonVGoogle by @samkogon
KOGON V. GOOGLE update: For everyone asking for an update on our case, Google just filed a response trying to get it thrown out. They’re basically arguing that because we clicked ‘accept’ years ago (long before AI was even a glimmer in anyone’s eye) it gives them a free pass to exploit our music and use it against us. It’s a very weak defense if you ask me. Just because they want this to go away doesn’t mean it will. We are going to keep fighting. This is just the beginning. My California dreams came true in the most unexpected way! I ran into @jonimitchell while thrifting and we spent a moment chatting about her Hollywood Bowl show, our mutual friends, and my involvement with The Left Banke. When I asked what’s next, she told me she’s been returning to her painting. Hearing that unmistakable laugh in person is a memory I’ll hold onto forever. Swipe for the most iconic sound in music history. I’ve looked at life from both sides now, and nothing compares to this. 💜☁️ by @samkogon

It’s been 10 years since Psychic Tears was released! I’m pleased to announce that I’m teaming up with @positively.la to reissue the album on vinyl featuring unreleased tape demos, live recordings, and extra bits. Keep your eyes peeled for details! My band recorded the main tracks in 2 days w/ @sam.evian behind the board @figure8recording then @frankiecombos came over to my former Brooklyn apt to lay down her vocals for our duet. The strings you hear on the album were arranged and performed by @_f.nolan. It was my first go at making a real solo studio album following up my debut which was made recording all the tracks at the same time and overdubbing a few vocals and strings. @mikenoomin believed in my music and made my psychedelic dreams come true of having my own LP on vinyl (a few rare ones on yellow vinyl are still floating out there!) We toured the album on the east coast, the mid west, west coast and Canada and shared stages with so many talented and wonderful musicians. To everyone who listened or picked up a copy over the last decade, thank you for keeping these songs alive! 💜💜💜 Album Credits: Written by Sam Kogon Produced by Sam Owens & Sam Kogon Arranged & Performed by Sam Kogon & The Heathens Engineered by @sam.evian Mixed by @gabewax Mastered by @ludvignylund String Arrangements by @_f.nolan Additional Engineering by @stereophobe Cover Artwork by @jessetreececollage Layout & Design by @alexmarkwith Photography by @jone_bone Recorded at @figure8recording in Prospect Heights, Brooklyn The Psychic Tears Band (aka The Heathens): Sam Kogon – Vocals, guitars, synths Joe Jakubowski – Keys, organ, woodwinds, percussion Finnegan Shanahan – Electric mandolin, strings / string arrangements Grennan Milliken – Drums Daniel Powell – Bass Greta Kline – Vocals on “I Was Always Talking” Alec Lambert – Trumpet on “The Way To Talk To Boys” All Songs © 2016 Kogon Music Publishing (@ascap) #psychictears #reissue #anniversary #positivelyrecords by @samkogon
