The Brief: half of influencer posts break this rule and most creators don’t even know it exists.

If a brand pays you, gifts you, lends you something, or gives you a code, that post is an ad in the eyes of the law. It has to say so, clearly, before the ā€œsee more.ā€ Not buried in the hashtags.

The bit people miss is that free stuff counts. No money has to change hands.

And this isn’t a slap on the wrist anymore. The regulator can now fine a business up to 10 percent of its global turnover, and it names the creator too.

I’m telling you this because it’s the exact thing brands want to know you understand before they work with you. Knowing the rules is the job.

The Brief: Google agreed to pay Ā£260m to UK developers this week. Everyone’s calling it a win. I’m not so sure.

Read the split and it gets awkward. Ā£160m goes to the developers. Ā£100m goes to the lawyers and funders who backed the case. That’s nearly 40% of the payout never reaching the people who were actually overcharged.

To be clear, that’s not dodgy, it’s just how UK class actions work. Someone has to fund a fight against a company like Google, and they take a cut for the risk. No funder, no case.

But here’s the kicker. Google didn’t have to change a thing. Its 30% Play Store fee stays exactly where it was. It paid for the past and kept the future.

A win for developers, or the cost of doing business for Google? Genuinely torn on this one.

Everyone is posting the $16.7 billion number but here’s the part that actually matters.

Meta didn’t lose this case. It bought its way out of one, and honestly, for a company that size, $16.7 billion is basically loose change down the back of the sofa. The kind of fine you can pay and still be in a good mood by lunch.

What I’ll be watching isn’t the money. It’s whether anything actually changes for the people who were harmed, because a cheque and an apology aren’t the same thing, and Meta somehow only found the budget for one of them.

Snap, YouTube and TikTok are next. They’ve seen the price list and they’re getting their wallets out.

Everyone I know with one of these treats the sleep score like gospel. Turns out a lawsuit is now arguing that number is closer to a guess than a measurement.

But the part that actually interests me as a lawyer isn’t the tech. It’s one word: ā€œ95%.ā€

A brand can say ā€œbuilt for accuracyā€ all day and get away with it. The second they put an exact number on it, it stops being marketing and starts being a promise they have to prove. That’s the whole case in a nutshell.

Oura denies it and says its science stands up, and to be fair nothing’s been proven yet.

Save this for the next time a product sells you a number.

But the judge already flagged that Section 230 and the First Amendment limit how far a court can go in redesigning an app.

A series where I unpack the business and legal side of the brands we all know.

First up: the one that could cost you money.
A billion pound brand got sued over the music in its reels back in 2021, and the labels never stopped.

Here’s the catch. The music you add in-app is licensed for personal use only. The moment a post becomes an ad or a brand deal, that licence no longer covers you. Copyright doesn’t care that you didn’t know.

And it’s not just the brand on the hook. Your deal makes you warrant the content is clean, so it can land back on you.
Rule of thumb: organic post, use what you want. Paid post, use what you’re licensed for.
