Ambition vs. Reality. Recent storms have battered the California coastline and city officals have red-tagged properties and ordered evacuations of multiple homes.

Would you live here if it meant waking up to this view every day. How long could you stand against the tide?

The lawmakers in the State of California are plotting, yet again, to ruin the recovery from the Palisades Fire and any future disaster that impacts a home in the Coastal Zone defined by the California Coastal Act of 1976.

Remember SB-549?

SB-1229 is worse!

330 homes in Malibu, abutting PCH, were ruined in January, 2025. State Senator Ben Allen told us that he would not do anything to hurt the 6 miles of beach homes that are trying to rebuild after that disaster. Well, it seems he lied. To me. To you.

To date, the City of Malibu has only issued 88 permits to rebuild the potentially 528 homes which housed lives upended by the Palisades Fire.

The fires are still wreaking havoc on all of us. State Senator Ben Allen appears to think that no one has the right to rebuild, like-for-like, if one's home sits within an ESHA corridor or along the Public Lands near the tidal zones of the State of California.

SB-1229, written by Ben Allen in February of 2026, would limit or eliminate a successor owner’s ability to rebuild a destroyed structure in California without Coastal Commission involvement. As if it isn't already difficult enough?! Adding CCC review will prolong the rebuilding process by at least 3 years for any homeowner applicant.

Historical precedent tells us that approximately 50% of homes turn over after a major wildfire in California. This is due to a number of factors, chief among them underinsurance and stage-of-life for victims who don’t feel they have the time to rebuild.

This is not a 'Malibu' problem.

It will affect any homeowner in an area deemed 'environmentally sensitive', which means all of us: Pacific Palisades. Palos Verdes. La Jolla. Laguna Beach. Carmel. Santa Barbara. Monterey. Marin County. And yes, our beloved Malibu.

Please voice your concerns over this horrendously overreaching SB-1229 to your State Assemblypersons.

DM me for a draft letter.
