There are many steps to take when you are suing a city like DC. The first step is a statutory requirement known as section 12-309, which mandates that DC receive pre-suit notice from the potential plaintiff or its representative. This is not required if you are suing officers in their individual capacities. D.C. Attorney General Brian Schwalb has a strange set of priorities: last year, he dropped all charges against the white supremacist Oath Keepers and Proud Boys members who participated in the violent insurrection at the U.S. Capitol on January 6, 2021. But now, he is wasting taxpayer dollars trying to block the mother of Deon Kay from getting a cash payment for her son’s murder by D.C. police in 2020.

In 2020, 18-year-old Deon Kay was murdered by MPD officer Alexander Alvarez in Southeast D.C. Last year, a jury of the D.C. Superior Court ruled in favor of a wrongful death lawsuit filed by Kay’s mother and granted the family a cash payment - a ruling Schwalb is now appealing.

Under the U.S. capitalist system, there are two systems of justice: one for the working class and oppressed, and another for the ruling class and its servants. A working-class Black family can be allowed no recompense, but participants in Donald Trump’s coup attempt aren’t worth the smoke for the D.C. District Attorney to prosecute.

We need a new system, one that holds racist police and racist insurrectionists accountable for their crimes - one that stands on the side of Black and working-class families. My law firm represents Marquette Hopps, a 28 year old DC resident who was stopped at a gas station on Minnesota Ave, SE by MPD officers who claimed the moped that he was filling up was stolen. It was NOT stolen. During the encounter Mr. Hopes informed officers that he had his weapon on him and presented his license to carry. DESPITE SHOWING THIS EVIDENCE, he was arrested and jailed. One year ago today, my trial team won justice for Deon Kay. Today, @dcattorneygeneral is fighting that verdict. Taxpayers are now paying $26,400 in interest on the award of $655,000 that a jury rendered last year. Update in the Kevin Shird Shooting Death Case: I am happy to announce that a trial date has been set in this case. On November 9 we select our jury. Only 1% of these cases make it to a jury so I am particularly happy about this and grateful to God to have the privilege of representing the strongest human beings in the planet.
